By-laws are a set of rules that all people within a strata scheme must follow. They apply to both lot owners and occupiers (tenants, visitors) and play a key role in ensuring Kings Bay Estate remains a great place to be for all residents and their guests. The following by-laws apply to everyone who either owns or lives within and visits Kings Bay.
1. Noise.
You must not make noise at any time within your lot or on common property that might disturb the peaceful enjoyment of other residents or anyone using common property.
2. Vehicles
You must not park or stand a vehicle on common property without written permission from the owners’ corporation. This includes in parking spaces designated for ‘Visitors’. Written permission does not give an owner or occupier a permanent right over that part of common property and such permission can be cancelled. Furthermore, to ensure everyone’s safety, you must comply with all traffic signage within the estate, such as ‘No Standing’ signs and speed limits.
3. Obstruction of common property
You must not stop the lawful use of common property by another person.
4. Damage to common property
You must not remove or damage any lawn, garden, tree, shrub, plant or flower on the common property. You must not use any part of common property as your own garden, including planting your own plants on common property. You must not damage any structure that is part of common property. You must not alter any such structure unless you have written permission from the owners’ corporation of the relevant Strata Plan. This by-law does not prohibit residents from installing a locking/safety device or screens for protection against intruders or to prevent harm to children or entry of animals/insects. However, they must be installed in a professional manner and comply with the appearance of the estate and requirements of your building. Owners are responsible for maintaining anything they have installed.
5. Lot Renovations and Alterations
Written consent is required from your relevant owners’ corporation to renovate your lot. Forms are available upon request from the Estate Manager
6. Behaviour of residents their visitors
You and your visitors must be adequately clothed when on the common property. You must not use language or behave in ways which might offend, embarrass or intimidate others using the common property.
7. Children playing on common property in building
Residents and their guests must ensure that any child under their supervision does not play on common property areas inside the building. Children must be supervised by an adult when on common property, the pool, the gym, car parking areas or other areas potentially dangerous to children.
8. Behaviour of visitors
As a resident please ensure your visitors comply with the by-laws and do not behave in any way (either within your lot or on common property) that might disturb or impact upon other residents and their guests.
9. Depositing rubbish/unwanted items on common property
You must not throw or dump any rubbish, dirt, dust or other material on common property. This includes the garbage bays where all rubbish must be placed in the appropriate bins.
10. Drying of laundry items
You and your guests must not hang washing, toweling, bedding, clothing or other articles on any part of the strata scheme, including the balcony of your lot, if it can be seen by others from outside the building or from other lots.
11. Cleaning glass windows and doors
As a resident, you are responsible for cleaning all glass windows and doors on the boundaries of your lot, even though they may be common property.
12. Storage of flammable liquids
You must get written permission from the relevant owners’ corporation if you want to store any flammable materials in your lot or on common property. However, you may store such materials without permission if they used for domestic purposes only.
13. Moving furniture etc. on or through common property
You must tell the Estate Manager if you are intending to move large objects or furniture through the common property areas of the estate and its buildings (e.g. deliveries, moving in/out.) This allows for the Estate Manager to monitor security and common areas, including preventing damage to your items and the lifts by installing lift curtains.
14. Floor coverings
An owner must cover the floor of their lot or treat it to stop noise that may disturb other residents. This does not apply to the kitchen, laundry or bathroom of a lot.
15. Garbage disposal
All residents are responsible for ensuring the garbage area in their own lot or on the authorised garbage bays on the common property are clean, dry and adequately covered.
Ensure your garbage is securely wrapped, that all tins and containers properly drained and that household garbage is not put in recycling bins.
Residents are responsible for ensuring that any rubbish spilt from garbage/recycling bins is cleared away. This includes unwanted household items, including furniture etc., which should be included in council cleanups and not dumped the garbage bays or on the verge. Doing so incurs Community costs that ultimately lead to increases in your strata fees and/or rents.
16. Keeping of animals
You must not keep an animal unless it is permitted by the specific by-laws of the Community association or your specific strata plan, whichever applicable. This particular by-law for your strata plan is available upon request from the Strata Manager.
17. Appearance of your lot
Unless you have written permission from the Community Association, you must not keep anything within your lot (including balconies) that is not in keeping with the appearance and quality of the rest of the estate or your building.
18. Community notice board
The Community Association’s notice board is located adjacent to the doors to the middle rise of “The George” high-rise building. It is the responsibility of residents to read the Community notices.
19. Community Gym
The community gym is available for use by residents for their own personal fitness purposes only. For insurance and other reasons, this does not include use of our gym by personal trainers working either with residents or otherwise. No equipment must be removed from the gym and for security reasons it is monitored using CCTV.
